N.J. Appellate Court Affirms Judgment for Insurer in Mold Exposure Suit

TRENTON, N.J. –– A New Jersey appellate court has affirmed an award of summary judgment to an insurer in a mold exposure suit, finding that a fungus exclusion barred the claims.

The New Jersey Superior Court, Appellate Division, opined in its Dec. 11 opinion that the policy language was not ambiguous and that “its own terms made clear” that it provided a single coverage for bodily injury and property damages.
