Missouri Court Remands Talcum Powder Lawsuit, Says Claims of 62 Plaintiffs Not Misjoined

ST. LOUIS –– A Missouri federal court has remanded a lawsuit alleging that use of talcum powder caused the development of ovarian cancer, rejecting the defendants’ argument that the claims were misjoined.
In the Dec. 3 opinion, the U.S. District Court for the Eastern District of Missouri wrote that it could not say that the claims had no “real connection to each other such that they are egregiously misjoined.”
The plaintiffs in the underlying action asserted 11 state law claims, “arising out of the design, testing, promotion, and sale of Johnson & Johnson Baby Powder and Shower to Shower,” the …
