Miss. Federal Court Refuses to Review Remand Order in Silica Case

JACKSON, Miss. ¬¬¬¬– A Mississippi federal court has denied a motion made by two silica defendants to review a recent remand order, saying that, even if it could review its decision, it would still find that the removal was untimely.
In the Nov. 12 order, the U.S. District Court for the Southern District of Mississippi noted that the plaintiffs had submitted supplemental evidence that backed their initial motion to remand.
In July, the federal court issued an order granting the plaintiffs’ motion to remand, finding that the defendants had not properly removed the suit within the requisite time period.
