Miss. Judge Refuses to Overturn Remand Order in Silica Exposure Case

NATCHEZ, Miss. — A Mississippi judge who recently remanded a trial-ready silica case based on the removing defendants’ failure to comply with the rule of unanimity has said he won’t reconsider the decision even after the defendants argued that they were the only two remaining in the case when the removal petition was filed.
In an order issued Sept. 29 in U.S. District Court for the Southern District of Mississippi, Judge David Bramlette ruled that he sees no reason to alter the decision, which the judge said was issued based on the facts presented by the defendants.
