11th Cir. Affirms Defense Verdict for DuPont in Farmer’s Benlate Exposure Case

ATLANTA — A federal appeals court has again upheld a verdict absolving E.I. DuPont de Nemours & Co. of liability in a lawsuit filed by a Florida farmer who claimed he developed cancer of the kidneys, brain and pancreas as a result of exposure to Benlate.

In a Sept. 11 decision, the 11th Circuit U.S. Court of Appeals ruled, as it did in December 2011, that the trial court did not err in allowing juror to hear testimony from DuPont’s key causation expert, whose opinions were based on analysis of Benlate products other than the one used by the …
