La. Court Issues Ruling on Motions to Dismiss NORM Exposure Suit, Throws Out Claims Against Employers

NEW ORLEANS –– A Louisiana court has issued an order addressing more than 20 motions to dismiss a NORM exposure suit, ruling in part that both pre-1975 and post-1975 versions of the Louisiana Workers’ Compensation Act barred some of the claims since both versions covered exposure for radioactive substances.

In the Sept. 2 order, the U.S. District Court for the Eastern District of Louisiana did permit the plaintiffs to proceed with intentional tort and strict liability claims against the defendants but deferred ruling on challenges to the timeliness of the claims, citing a pending appeal before the state high court.
