BEAUMONT, Texas - A Texas appeals court has refused to disturb what is believed to be one of the largest single-plaintiff verdicts in the history of silica-related personal injury litigation. U.S. Silica Co. v. Tompkins, No. 09-01-377 (Texas App. Ct., Ninth Dist.).
In an opinion issued Nov. 21, the Ninth District Texas Court of Appeals ruled that a Jefferson County District Court jury was presented with sufficient to support its previous finding that the death of Donald Tompkins was caused by the negligence of U.S. Silica, the successor in interest to two defendants in the case.
