Texas Court Reverses Enforcement of Settlement Agreement in Hydrogen Sulfide Exposure Suit

HOUSTON –– A Texas appellate court has reversed the enforcement of a settlement agreement in a hydrogen sulfide exposure suit, finding that the plaintiff had sufficiently indicated his intent to withdraw consent after determining that he could no longer pursue separate benzene and dimethyl disulfide exposure claims under the terms of the agreement.
In the Aug. 28 opinion, the Texas 14th District Court of Appeals opined that the trial court erred when it found sufficient proof to support a judgment entered in favor of BP Products North America.
