N.Y. Federal Court Awards Summary Judgment to Union Carbide in Chemical Release Suit

NEW YORK –– A New York federal court has awarded Union Carbide summary judgment in a hazardous chemical release suit, finding that the plaintiffs had not proven that the defendant played a “sufficiently direct role” in causing the chemicals to seep into the surrounding soil and drinking water.

In the July 30 opinion, the U.S. District Court for the Southern District of New York in part found that there was no evidence that Union Carbide determined the method of waste disposal at the foreign facility.
