TRENTON, N.J. –– A New Jersey appellate court has affirmed the dismissal of formaldehyde exposure claims asserted against a builder, finding that the plaintiffs had not presented enough evidence to support their Consumer Fraud Act, common law fraud or negligent misrepresentation claims.
In the Aug. 6 opinion, the Appellate Division of the New Jersey Superior Court further found that the trial court did not err when it refused to allow the plaintiffs to amend their lawsuit with a negligence cause of action.
