Louisiana Federal Court Retains Jurisdiction Over Lead Paint Exposure Suit

NEW ORLEANS –– A Louisiana federal court has retained jurisdiction over a lead paint exposure suit, opining that the defendants were not made aware that removal was available until the plaintiffs filed their first amended complaint.

In an Aug. 12 opinion, the U.S. District Court for the Eastern District of Louisiana noted that it was not until the first amended complaint was filed that the plaintiffs reference a federal statute.

“…Plaintiffs either obscured the federal question or were unaware of its existence,” the court found.
