Hawaii Federal Court Rejects Efforts to Dismiss Pesticide Complaint Asserted by Military Families

HONOLULU –– A Hawaii federal court has in part rejected efforts by two housing defendants to dismiss a complaint filed by military families who claimed that the soil at their residences was contaminated with pesticides.

In the July 15 opinion, the U.S. District Court for the District of Hawaii allowed the majority of the claims to proceed, but also granted the motion as to specific breach of contract, negligence and fraud claims with leave to amend.

The plaintiffs in the underlying action are military families who resided at a U.S. Marine Corps Base starting in 2006. In their class action …
