NEW BERN, N.C. –– A North Carolina has granted an unopposed motion for summary judgment in a pesticide case, concluding that the plaintiff was required to provide facts supporting the alleged exposure, whether through expert testimony or otherwise.
In the July 14 order, the U.S. District Court for the Eastern District of North Carolina additionally noted that the plaintiff had failed to “forecast any expert testimony by the expert disclosure deadline.”
