CLEVELAND –– Plaintiffs with claims pending in the national C-8 personal injury litigation multidistrict litigation docket have opposed efforts to dismiss what defendant DuPont recently argued was “over 60 improperly joined plaintiffs.”

In June 23 response, filed in the U.S. District Court for the Southern District of Ohio, the plaintiffs refuted DuPont’s assertion that the plaintiffs’ claims do not arise out of the same series of transactions or occurrences, arguing that a 2004 settlement agreement in which all the plaintiffs were parties satisfies this joinder requirement
