Ala. Supreme Court Allows Wantonness Claims to Proceed in Chemical Exposure Case

BIRMINGHAM, Ala. –– The Alabama Supreme Court has affirmed in part trial court rulings allowing chemical exposure wantonness claims to proceed against a number of defendants, ruling that recent changes in state case law did not preclude the claims.

In the June 20 opinion, the high court weighed in on the toxic exposure case for the third time, in part concluding that a trial court should have thrown out conspiracy claims asserted by the plaintiffs.
