BOSTON — A federal appeals court has affirmed an award of summary judgment to Raytheon in a class action seeking medical monitoring for individuals who allegedly experienced subcellular changes following exposure to beryllium.
In rejecting the plaintiffs’ case, the 1st Circuit U.S. Court of Appeals said June 10 that a lack of evidence that any of the putative class members suffered subcellular or other physiological changes as a result of their exposures failed to support a medical monitoring cause of action under Massachusetts law.
