Calif. Court Dismisses Chemical Exposure Claims Against Mobil Oil, Exxon Mobil

LOS ANGELES –– A California federal court has dismissed chemical exposure claims brought against Mobil Oil and Exxon Mobil (NYSE:XOM) after determining that the plaintiffs had not asserted allegations that could overcome the workers’ compensation exclusivity bar.
In the May 30 decision, the U.S. District Court for the Central District of California ruled in part that the plaintiffs had failed to prove that the former employers knew the decedent suffered from a workplace injury, a requirement for bringing fraudulent concealment claims under an exception in the exclusivity provision.
