Maine Supreme Court Orders New Trial in Lead Paint Exposure Suit, Cites Wrongfully Excluded Expert Testimony

PORTLAND, Maine –– The Maine Supreme Judicial Court has ordered a new trial in a lead paint exposure case, finding that a trial court erred when it excluded portions of plaintiffs’ expert testimony on grounds that the experts did not have medical degrees.
In the May 6 opinion, Maine’s highest court additionally found that there was sufficient evidence to support a jury finding that the plaintiffs suffered intentional infliction of emotional distress and were entitled to punitive damages.
