Ohio Court Rejects Efforts to Amend CMO in C-8 Exposure MDL, Says State Court Filings ‘Clearly Foreseeable’

COLUMBUS, Ohio –– An Ohio court overseeing the federal C-8 exposure multidistrict litigation docket has rejected efforts by E.I. Du Pont de Nemours and Company to modify the docket’s case management order, saying the defendant knew that the “potential number of plaintiffs was extraordinary.”
In the May 5 order, the U.S. District Court for the Southern District of Ohio opined that the filing of nearly 1,000 C-8 exposure cases in state court was “clearly foreseeable.”
