DuPont Moves to Amend CMO in C-8 Exposure MDL, Cites Recent State Court Filings

COLUMBUS, Ohio –– E.I. Du Pont de Nemours and Company has moved to modify the case management order governing the federal C-8 exposure multidistrict litigation docket, saying that plaintiffs’ counsel decision to file nearly 1,000 complaints in state court “actively undermine[s] the MDL.”
In the April 10 motion filed in the U.S. District Court for the Southern District of Ohio, DuPont said that the plaintiffs’ firm Hill, Peterson, Carper, Bee & Deitzler recently filed 966 C-8-related complaints in the Circuit Court of Wood County, W.Va., and have indicated that they anticipate filing 1,800 more lawsuits in the upcoming months.
