Miss. Supreme Court Reverses $1.7 Million Silica Verdict, Cites Insufficient Causation Evidence

JACKSON, Miss. –– Mississippi’s highest court has reversed a $1.7 million silica verdict, ruling there was insufficient evidence presented at trial showing that the deceased plaintiff was exposed to Mississippi Valley Silica Inc.’s sand for “any significant period of time.”

In the April 17 order, the Mississippi Supreme Court also held that there were no expert calculations quantifying the extent of the plaintiff’s alleged exposure, or a determination of how much sand came from Mississippi Valley. As a result, the court ruled, the evidence did not support the jury’s verdict.
