SOUTH BEND, Ind. — A federal judge in Indiana has thrown out causation opinions from three experts who testified for the family of two children who were allegedly injured as a result of exposure to vinyl chloride from a Textron Inc. facility located near their home.
Judge Philip P. Simon ruled March 17 that the testimony fails to establish a link between the alleged exposure and the plaintiffs’ injuries because the conclusions are based on extrapolation of data from studies involving levels of vinyl chloride significantly higher than those to which the plaintiffs were exposed.
