Pa. Court Declines to Adopt Recommendation Tossing Plaintiff Expert Testimony in Radioactive Uranium Exposure Case

PITTSBURGH –– A Pennsylvania federal court has declined to adopt a number of recommendations made by a magistrate judge, instead rejecting admissibility challenges to the testimony of four plaintiff experts in a radioactive uranium exposure case.

In the Feb. 27 opinion, the U.S. District Court for the Western District of Pennsylvania denied challenges to expert testimony from both sides, ruling in part that the plaintiff experts did not need to quantify the dose of the alleged exposure so long as they adequately supported their position that the exposure exceeded background levels.
