Firmenich Employees Unable to Assert Diacetyl Injury Claims Against Bankrupt Chemtura

NEW YORK – A federal court has barred claims by nine employees of a company that purchased diacetyl ingredients from debtor Chemtura Corp., saying that any potential claims were discharged in bankruptcy proceedings.
U.S. District Judge Jesse M. Furman of the U.S. District Court for the Southern District of New York on Feb. 10 affirmed a decision by the Southern District Bankruptcy Court, which rejected assertions by Firmenich employees that their claims were not affected by a filing deadline because they were unaware of their diacetyl-related injuries at the time claims against Chemtura were discharged.
