MONTGOMERY, Ala. – The Alabama Supreme Court has affirmed summary judgment for the contract operator of a lime quarry that was found to be a “special employer” and not liable for purposes of a negligence action brought by an injured worker employed through a temporary service agency.
The 8-1 court majority affirmed the decision of the Shelby (Ala.) Circuit Court without issuing an opinion Jan. 24, while Chief Justice Roy S. Moore set out the issues involved in his nine-page dissent.
