Raytheon Workers Ask 1st Circuit to Overturn Summary Judgment in Beryllium Exposure Case

BOSTON – Former Raytheon workers and family members who allege an increased risk of chronic illness from exposure to beryllium dust argue in their opening brief to the 1st Circuit that the trial court misinterpreted Massachusetts' standard for medical monitoring in granting Raytheon's motion for summary judgment.
They urge the appellate court to reverse the recent ruling by the U.S. District Court for the District of Massachusetts, and predict in their Jan. 8 brief that failure to do so “will effectively terminate the medical monitoring remedy” in the commonwealth.
