N.J. Federal Judge Remands Suit Filed by CSX Train Derailment Responders

CAMDEN, N.J. – A federal judge in New Jersey has declined jurisdiction in a personal injury lawsuit filed by police and other responders to a 2012 freight train derailment that resulted in a vinyl chloride release.
In ruling Jan. 13 that the U.S. District Court for the District of New Jersey did not have jurisdiction, Judge Robert B. Kugler declined to dismiss claims by the one Pennsylvania resident whose dismissal might have left only diverse parties to the lawsuit.
The action was originally filed in state court in Pennsylvania by plaintiffs who responded to a 2012 accident in Paulsboro, N.J., …
