ST. PAUL, Minn. – The Minnesota Court of Appeals has affirmed a trial court's denial of post-verdict, prejudgment interest in an employee injury case brought under the Federal Employer's Liability Act, saying the act does not allow recovery.
The court rejected plaintiff Dennis E. Kinworthy's argument that post-verdict interest is available under Minnesota law, saying the issue is governed by FELA.
Kinworthy prevailed at trial against Soo Line Railroad Co. (d/b/a CP Rail System), with a jury awarding damages of $340,000 for injuries he received while working as a CP Rail conductor in 2009.
