WILMINGTON, Del. — The Delaware Chancery Court has denied an injunction sought by an insurer for Mine Safety Appliances to prevent the insured from transferring its coverage rights to plaintiffs in underlying West Virginia tort actions or assisting in any litigation other than pending coverage actions in Delaware and Pennsylvania.
Vice Chancellor Sam Glasscock III said Dec. 20 in denying North River Insurance Co.’s “unusual request” that the equitable relief sought would not prevent the irreparable harm alleged and “would itself create serious equitable concerns.”
