Imerys Sues Zurich American Insurance Co. to Recover $4 Million Spent Defending Talc Injury Lawsuit

CHICAGO – Imerys Talc America Inc. has filed a declaratory judgment action against Zurich American Insurance Co. saying the carrier has failed to contribute to the defense of a talc injury lawsuit despite having acknowledged liability.
Imerys (formerly Luzenac America Inc.) filed the lawsuit Dec. 6 in the U.S. District Court for the Northern District of Illinois.
Imerys says it has spent $4 million to date defending a lawsuit filed by Deane Berg against several defendants, including manufacturer Johnson & Johnson, over Berg’s claim that her ovarian cancer resulted from decades of using Johnson’s Baby Powder and Shower to Shower …
