Ohio Courts Deny Law Firm’s Bid for Sanctions in Dispute with Former Partner over Diacetyl Case Fees

CLEVELAND, Ohio – An Ohio appellate court has affirmed a trial court’s denial of sanctions sought by a law firm that prevailed in litigation with a former partner over fees owed for representing clients in diacetyl food flavoring cases.
The Eighth Appellate District, County of Cuyahoga, on Nov. 27 also affirmed the lower court’s refusal to order opposing trial counsel to turn over their client’s case file in a bid for evidence to support their claim that the litigation was frivolous.
