SIOUX FALLS, S.D. — A South Dakota federal judge has let stand a jury finding of negligent failure to warn against Johnson & Johnson Consumer Cos. in a case alleging that use of the company’s talc products led to ovarian cancer.
Judge Karen E. Schreier, who had presided over the recent trial in the U.S. District Court for the District of South Dakota, said in her Nov. 19 order on defendant’s motion for judgment as a matter of law that there was substantial evidence to sustain plaintiff Deane Berg’s negligent products liability action.
