Del. Court Dismisses Banana Workers’ Chemical Exposure Suit for Forum Non Conveniens

WILMINGTON, Del. — A Delaware trial court has dismissed a chemical exposure suit brought against Dole Food Company Inc. and other defendants by workers on foreign banana plantations, saying that the claims are nearly identical to those already brought in a Louisiana forum.
Superior Court Judge Andrea L. Rocanelli ruled Nov. 8 that the case met the criteria set out in McWane v. McDowell (263 A. 2d 281 [Del. 1970]) for applying the doctrine of forum non conveniens and she granted the defendants’ motion to dismiss on that basis.
