Del. Trial Court Narrows but Declines to Dismiss Birth Defect Suit Against Intel

WILMINGTON, Del. — Delaware’s Superior Court has denied dismissal sought by Intel Corp. (NASDAQ:INTC) on claims by that a Colorado couple’s exposure to toxic substances at semiconductor manufacturing facilities caused their son’s birth defects.
Superior Court Judge Jan R. Jurden denied Intel’s motion Oct. 9, rejecting the company’s argument that the claims are not available under Colorado law.
However, the judge did rule that Colorado’s Premises Liability Statute applied and that it abrogated plaintiffs’ common law tort claims.
