FRANKFORT, Ky. — Kentucky’s Court of Appeals has affirmed disability benefits awarded to a former employee of Lubrizol Advanced Materials Inc., who claimed her hypersensitivity pneumonitis was caused by workplace exposure to antigens.
The court docketed a notice Sept. 9 finalizing its July 26 order in favor of claimant Debra Hendricks, who was awarded temporary total disability and permanent partial disability benefits, as well as medical expenses.
Hendricks submitted her claim on March 30, 2011, maintaining that her pneumonitis resulted from exposure to chemical and “noxious elements” at a Lubrizol facility in Louisville, Ky., where she was employed from 1987 …
