CAMDEN, N.J. - CSX Transportation and other defendants in a suit brought by police and other responders to a Nov. 30 train derailment have removed the action to federal court while asking that the claims of one non-diverse plaintiff be severed to allow for removal.
Defendants filed their notice of removal Sept. 19 in U.S. District Court for the District of New Jersey, filing an amended notice a day later in which they asserted that the non-diverse plaintiff was added to the complaint to defeat the court's diversity jurisdiction.
