CHARLESTON, W.Va. — A former worker in a West Virginia aluminum mill lost his bid for occupational pneumoconiosis benefits when that state’s high court affirmed that the claimant failed to show occupational exposure to metals dust for a continuous two-year period as required by statute.
West Virginia’s Supreme Court of Appeals said Sept. 12 in affirming the decision by the Workers’ Compensation Board of Review that the board made no prejudicial errors in affirming a decision for Alcan Rolled Products – Ravenswood LLC, a subsidiary of Constellium, headquartered in Amsterdam (NYSE:CSTM).
