NEW YORK — A federal court has granted summary judgment to a municipal defendant accused of violating the Americans with Disabilities Act and other federal statutes by failing to accommodate an office worker seeking reassignment to avoid exposure to construction dust and other lung irritants.
U.S. District Judge J. Paul Oetken ruled Aug. 28 that William Jacobsen’s civil rights and ADA claims were time-barred and that he had no private right of action under the Occupational Safety and Health Act.
