WILMINGTON, Del. — The Delaware Supreme Court has declined to address the merits of a ruling on the admissibility of expert testimony in a toxic tort case against Advanced Micro Devices Inc. pending further review by the trial court on the testimony’s reliability under Delaware law.
The high court acknowledged in its Aug. 16 remand order that the trial court was not required to determine reliability previously, having ruled instead that the testimony would be irrelevant because it was inadmissible under the substantive Texas law applied in this case.
