Ala. Court Affirms Ruling for North American Bus Industries in Painter’s Toxic Chemical Suit

MONTGOMERY, Ala. — The Alabama Court of Civil Appeals has affirmed that a toxic exposure suit brought by an employee of North American Bus Industries is barred by the exclusivity provisions of that state’s Workers’ Compensation Act.

The court also held in its Aug. 9 opinion that final judgments entered in workers’ compensation cases need not include findings of fact and conclusions of law despite a two-decade-old opinion holding otherwise.

Anthony Devero appealed from the summary judgment awarded to NABI on Devero's claim of toxic exposure from unknown chemicals while employed as a bus painter for two years.
