MINEOLA, N.Y. — A New York trial court has denied a plaintiff’s effort to reinstate pesticide exposure claims against former defendant Velsicol Chemical Corp., saying the motion failed to meet a 3-day deadline mandated by a Stipulation of Discontinuance.
Nassau County Supreme Court Justice Denise Sher, who earlier dismissed five counts as time-barred, ruled June 5 that not only was the motion untimely, but the discontinuance must now be entered with prejudice pursuant to the terms of the December 2012 agreement.
