WILMINGTON, Del. - The insurers in a coverage action involving coal dust claims must produce reinsurance agreements relating to the underlying policies at issue, a Delaware judge has ruled, upholding a special discovery master’s ruling.
On June 6, Judge Mary M. Johnston of the New Castle County (Del.) Superior Court further ordered the insurers asserting an untimely notice defense to produce all non-privileged reinsurance communications concerning when the insurer received notice of a claim against MSA and when the insurer gave notice to its reinsurer of such a claim.
