Court Declines to Order HHS to Renew FOIA Search for Formaldehyde Study Records

WASHINGTON, D.C. — A federal judge has denied a request by the American Chemistry Council Inc. that it order a federal agency to conduct an additional search for records pertaining to a formaldehyde study despite the agency’s assurance that the search would be duplicative.

Judge James E. Boasberg of the U.S. District Court for the District of Columbia said in granting the U.S. Department of Health and Human Service’s motion for summary judgment that HHS has shown its response to ACC’s Freedom of Information Act Request was reasonable and adequate, as the law requires.
