COLUMBUS, Ohio — An Ohio appellate court has affirmed summary judgment for an employer, ruling that evidence of alleged negligence or recklessness does not support an intentional tort claim that would allow for recovery outside the workers’ compensation system.
Ohio’s 10th Appellate District affirmed a ruling by the Franklin County (Ohio) Court of Common Pleas in favor of International Masonry Inc., June 27, rejecting arguments that the lower court erred in its findings of fact and that genuine questions remain to preclude summary judgment.
