BOSTON — A Massachusetts federal judge has awarded summary judgment to Raytheon (NYSE: RTN) on workers’ claims for medical monitoring for potential beryllium disease, ruling that plaintiffs lack necessary evidence of subcellular or physiological change from exposure.
Judge Mark L. Wolf of the U.S. District Court for the District of Massachusetts filed his ruling June 23, rejecting plaintiffs’ contention that their “increased risk” of subcellular change was sufficient to maintain a medical monitoring claim under the commonwealth’s relevant case law.
