D.C. Circuit Declines to Review Penalties Against Millard Refrigeration for Ammonia Leak

WASHINGTON, D.C. — A federal appeals court has denied Millard Refrigeration Services’ petition for review of penalties assessed by workplace safety officials for an accidental release of 30,000 pounds of anhydrous ammonia, concluding that the appeal was without merit.

The June 7 decision by the U.S. Court of Appeals for the District of Columbia Circuit left in place $15,250 in penalties assessed by the U.S. Department of Labor’s Occupational Safety and Health Administration for emergency response, record-keeping, training and other safety violations.

The penalties came after a release of the highly corrosive substance from a Millard facility in Theodore, Ala. …
