NEW YORK — A New York trial court has affirmed a decision by the New York Police Pension Fund rejecting an accidental disability pension petition by a police officer who linked his mononucleosis and related chronic fatigue diagnosis to toxic exposures stemming from the World Trade Center attacks on Sept. 11, 2001.
The New York County Supreme Court ruled May 7 that retired New York City Police Officer Pierino Anastasio’s illness is not covered by the presumption of work-related injury for WTC responders, and that the decision by the Pension Fund’s Medical Board was not arbitrary or capricious.
