NEW YORK — A New York Supreme Court justice asked to reconsider his rejection of expert testimony in a gasoline-birth defects case has, instead, reiterated his conclusion that the proffered experts did not follow generally accepted scientific methodology.
After a point-by-point rebuttal of plaintiffs’ counsel’s “facts overlooked by the court,” New York County Supreme Court Justice Louis B. York’s May 10 order also denied plaintiffs leave to appeal the court’s original Dec. 12 decision to exclude the testimony.
