RENO, Nev. — A federal court has denied the U.S. Department of Labor’s request that it reconsider an order allowing a former uranium miner to seek judicial review of the department’s denial of his federal benefit claim despite his late filing.
Judge Larry R. Hicks of the U.S. District Court for the District of Nevada said in his May 9 order that the filing defect was “minor,” and that the Labor Department had been on notice since the petitioner filed an earlier, timely action that was dismissed on procedural grounds.
