CLEVELAND-A Virginia man filed a wrongful death lawsuit against the distributors of silica-containing products and the manufacturers of respirators claiming that their products were defective and that they failed to properly warn of the dangers associated with the silica. Ross v. Allied Mineral Products, et al., No. CV-02-474018 (Ct. Comm. Pleas, Cuyahoga Cty. Ohio).
Harry Wallace Ross' June 26 complaint alleges that over 45 companies, which sold machinery that produced silica dust or called for the use of silica, are severally and jointly liable for his father's silica-and dust-related lung injuries and death in March.
